Terms of Service

1. Acceptance of Terms

These Terms of Service (“Terms”) govern your use of communications and digital services provided by DEC Fire & Water Restoration (“DEC,” “we,” “us,” or “our”). By engaging our restoration services, providing your contact information, or interacting with our digital communications, you agree to these Terms.

2. Services Provided

DEC Fire & Water Restoration provides property restoration services including but not limited to water mitigation, construction, pack-out, and commercial cleaning. Our digital communications system supports these services by facilitating:

  • Appointment scheduling and coordination
  • Job status updates and notifications
  • Insurance claim coordination and documentation
  • Payment processing and billing notifications

3. SMS / Text Message Terms

3.1 Consent

By providing your mobile phone number to DEC or its representatives, you expressly consent to receive automated and manually initiated SMS text messages from DEC Fire & Water Restoration related to your restoration project.

3.2 Message Types

You may receive text messages including:

  • Appointment confirmations and scheduling updates
  • Equipment set, monitoring, and removal notifications
  • Insurance claim status and approval notifications
  • Payment reminders and invoice notifications
  • General project updates from your assigned coordinator

3.3 Opt-Out

You may opt out of SMS communications at any time by replying STOP to any message. After opting out, you will receive one final confirmation message. To resume messages, reply START. Note that opting out may affect our ability to provide timely project updates.

3.4 Message Frequency and Costs

Message frequency varies based on your active restoration project. Message and data rates may apply based on your mobile carrier plan. DEC does not charge for SMS communications.

3.5 Non-Sharing of Mobile Numbers

Mobile phone numbers provided to DEC Fire & Water Restoration will NOT be shared with third parties for marketing or promotional purposes. Your number is used solely to deliver communications related to your active restoration project.

3.6 Help

For assistance with SMS communications, reply HELP to any message or contact us directly at the information provided in Section 10.

4. Email Communications

By providing your email address, you consent to receive transactional emails from DEC related to your restoration services, including estimate packets, insurance correspondence, invoices, and project updates. You may opt out of non-essential emails by contacting us directly.

5. Payment Terms

Payment for restoration services is due in accordance with your signed service agreement. DEC may send payment reminders and invoice notifications via SMS and email. Payment links included in communications are provided through secure third-party payment processors. DEC does not store payment card information on our systems.

6. Insurance Coordination

DEC coordinates directly with insurance companies on your behalf when authorized. By engaging our services, you authorize DEC to:

  • Submit estimates and documentation to your insurance carrier
  • Communicate with your adjuster and broker regarding your claim
  • Receive claim payments on your behalf as agreed in your service contract

DEC is not responsible for decisions made by your insurance carrier regarding claim approval, amounts, or timelines.

7. Intellectual Property

All materials, documentation, estimates, and reports prepared by DEC remain the property of DEC Fire & Water Restoration until payment is received in full. Estimate packets and job documentation are provided for your personal use in connection with your insurance claim and may not be shared or reproduced for commercial purposes.

8. Limitation of Liability

To the fullest extent permitted by law, DEC shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our digital communications systems. Our total liability for any claim related to digital communications shall not exceed the amount paid for the services giving rise to the claim.

9. Governing Law

These Terms are governed by the laws of the State of Alabama. Any disputes arising under these Terms shall be resolved in the courts of Alabama.
